42" Plasma Sweepstakes Official Rules

NO PURCHASE NECESSARY

Open Only to U.S. and Canadian (excluding Quebec) Legal Residents

1. INTRODUCTION: The 42" Plasma TV Sweepstakes is sponsored by Equifax eMarketing Solutions, Inc. (referred to herein as "Equifax Marketing Services"), 999 Yamato Road, Suite 300, Boca Raton, FL 33431, a wholly-owned subsidiary of Equifax, Inc. and may be offered in conjunction with subsidiaries, divisions and/or affiliates of the Sponsor and/or with multiple companies (each a "Promoter" and collectively, the "Promoters") through different web sites (collectively, the "Web Sites"). EMSPermission.com is owned and operated by Equifax Marketing Services. The sweepstakes is offered to legal residents of the United States and Canada (excluding Quebec), as confirmed by a valid government-issued photo identification. The sweepstakes is offered via the Internet only to legal residents of the United States and Canada (excluding Quebec), except where prohibited.

   ONLY ONE (1) WINNER ACROSS ALL WEB SITES WILL BE SELECTED. ALL DRAWINGS ARE CONDUCTED 30 DAYS AFTER THE POSTED END DATE (ABOVE) FOR EACH INDIVIDUAL SWEEPSTAKES.

2. HOW TO ENTER: NO PURCHASE NECESSARY to become a member of Sponsor or to enter any sweepstakes. You may enter each sweepstakes either: online through the www.emspermission.com; online through the entry form located at Promoters' web sites; or by printing your first and last name, date of birth, complete address, e-mail address, and day and evening phone numbers on a 3" x 5" card and mailing the card in an envelope by U.S. or Canadian mail to: Permission 42" Plasma TV, Department "Entries", 1621 18th Street, Suite 300 Denver, CO 80212. Please specify on the 3" x 5" card which sweepstakes is desired. Limit 1 card per envelope.

   Each entrant may submit no more than 100 total (online plus mail) entries per sweepstakes per day. Entries are not valid unless the entry form or card is properly completed and a valid e-mail address is provided.

3. ELIGIBILITY: Sweepstakes program is open only to legal residents of the United States and Canada (excluding Quebec) who are 18 years of age or older at the time of entry. Entrants must have Internet access prior to entering the sweepstakes. If a motor vehicle is a prize in the sweepstakes, the potential winner must have a valid license to operate the motor vehicle at the time the prize is awarded. Employees of SPONSOR, any of its subsidiaries or affiliates, or any Promoter, or any of their consultants, advertising agencies and promotional agencies, and immediate families (spouses, parents, children, siblings) and household members of such employees are not eligible.
4. CONDITIONS OF ENTRY: By entering sweepstakes, you agree to be bound by these Official Rules and by the decisions of the judges, which shall be final and binding in all respects. You also consent to the use of your name and/or likeness by SPONSOR and any Promoters for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. Neither SPONSOR, any Promoters or any of their consultants, agencies or employees nor any telephone network or service provider is/are responsible for incorrect, inaccurate or incomplete transcription of entry information; for lost, stolen, late, or misdirected entries; for destruction or alteration of entries; for unauthorized access to entries; or for any human error, technical malfunction, delay in operation or transmission, lost data, omission, interruption, deletion, defect, communications line failure, computer equipment, software, inability to access any Web site or online service, or any other error or malfunction. In the event of a dispute as to any entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the "authorized account holder." The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Proof of sending will not be deemed to be proof of receipt by Sponsor.
5. PRIZE: A separate sweepstakes is conducted for each of the prizes identified immediately above these Official Rules. The identities and approximate values of the prizes set forth immediately above these Official Rules are incorporated herein by reference. These Official Rules govern each of the sweepstakes. Winner will be selected in a random drawing from among all eligible entries received.

   Odds of winning depend upon the number of eligible entries received from all Web Sites and by U.S. and Canadian mail. Purchasing a product from any of SPONSOR's sponsors or Promoters, or from Promoters' sponsors, will not improve your chances of winning this sweepstakes or any other sweepstakes featured at www.EMSPermission.com. Potential winner will be notified by e-mail message, at which time his/her address will be confirmed. Potential winner has fourteen (14) days to respond to e-mail, after which time potential winner forfeits his/her chance to win the prize and a new potential winner will be selected. SPONSOR assumes no responsibility for an incorrect e-mail address, bounced-back e-mail messages, mechanical or technical failure of any kind, or lost, late or misdirected e-mail. Return of any prize notification as undeliverable by e-mail will result in disqualification and the selection of an alternate potential winner. Entrants are encouraged to print out a copy of these Official Rules for future reference. Alternatively, a copy of these Official Rules can be obtained by sending a self-addressed stamped envelope (residents of VT may omit return postage) to: SPONSOR Rules for Sweepstakes, 999 Yamato Road, Boca Raton, FL, 33431. All state, federal and local taxes (if any) are the sole responsibility of the winner. SPONSOR will furnish to the Internal Revenue Service or the Canadian Customs and Revenue Agency any required tax reporting forms relating to the award of any prize, including Form 1099-MISC. If the prize is a motor vehicle, the winner will be responsible for tags, tax, title, insurance and registration. No prize substitution, cash substitution, or assignment or transfer of prizes is permitted, except by SPONSOR because of unavailability, in which case a prize of equal or greater value will be awarded.

6. GENERAL CONDITIONS: This sweepstakes is subject to all applicable federal, state, provincial and local laws. Void where prohibited. Entrants hereby agree that SPONSOR, any Promoters or any of their consultants, agents or employees or any telephone network or service provider shall not be liable for any injury, loss or damage of any kind (including but not limited to damage to computer equipment) resulting from participation in this sweepstakes, downloading, or the acceptance or use of any prize awarded. SPONSOR reserves the right to verify eligibility qualifications of any potential winner. Potential winner will be required to execute an affidavit of eligibility and a liability/publicity release within ten (10) days of attempted notification. Failure to comply within this time period may result in disqualification and awarding of the prize to an alternate entrant. Canadian residents must correctly answer a time-limited skill-testing question to win a prize. Neither SPONSOR nor any Promoter is responsible for typographical or other errors in the offer or administration of any sweepstakes offered through EMS Permission, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner of any prize or the distribution of any prize. SPONSOR reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the sweepstakes. If for any reason the computerized and Internet portion of this sweepstakes is incapable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, strike, act of God, or any other cause beyond the control of SPONSOR, SPONSOR reserves the right, at its sole discretion and without obligation or prior notice, to cancel, terminate, modify or suspend Points for Sweeps. In such event, SPONSOR. may conduct a drawing to award the prize using all eligible entries received as of the time of cancellation, termination, modification or suspension. SPONSOR reserves the right to disqualify any individual who tampers with the entry process or any other aspect of the sweepstakes.
7. MISCELLANEOUS: There is no affiliation between SPONSOR and any prize manufacturers, retailers or service providers; nor have any such companies endorsed SPONSOR or any sweepstakes sponsored by SPONSOR Trademarks of companies other than SPONSOR, when used in connection with promotions featured by SPONSOR or any Promoters, are the property of the trademark owners and are used by SPONSOR and/or Promoters for identification purposes only.
8. PRIVACY: Personal information is collected from entrants when they participate in the sweepstakes. Please see the Privacy Policy at www.EMSPermission.com. Information collected may also be subject to the privacy policy of the applicable Promoter. See such Promoter's privacy policy at Promoter's web site for details.
9. WINNER'S NAMES: Winner's name will be posted on the Winners page at www.EMSPermission.com and linked from all Promoters' Web Sites for a minimum of 14 days, after which it may be removed. Alternatively, you can obtain the winner's name by sending a self-addressed stamped envelope (residents of VT may omit return postage) to: Winners' List, 999 Yamato Road, Boca Raton, FL, 33431. Indicate the sweepstakes on your request. Requests received more than 60 days after the end of the sweepstakes will not be honored.
